Dear Mr. Stoiber:
Enclosed for your review is an export license application from Molycorp, Inc. with a request for a broad license to export small amounts of thorium contained in rare earth products in concentrations ranging from.05 percent to 1.0 percent. Thorium,as a natural contaminant of the rare earth, can not be economically extracted from the compounds. Rare earths are used for many commercial applications including glass polishing compounds and television tubes.
Last year Molycorp exported almost 7,700,000 kilograms of rare earth products containing 6,400 kilograms of thorium, for an average thorium content of.083 percent. Most of Molycorp's exports are to Western European countries and Japan.
To expedite the licensing process, NRC issued the enclosed Export License XT08552 to Molycorp on October 8,1982 to cover those countries Molycorp exports to on a regular basis.
The license is limited to include only countries not requiring Executive Branch review.
In regard to including additional countries on the license, we advised Molycorp that Export License XT08552 could be amended to increase the amount of thorium to 100,000 kilograms contained in rare earth products in concentrations up to 1.0 percent to most countries, with certain quantity limitations. The proposed l
license would be similar to NRC's Export License XM08522 to the Gerard Kluyskens Company which was issued on July 21, 1 981, after Executive Branch review.

appreciate your views, in accordance with established procedures and from the overall perspective of the Executive Branch, as to whether the proposed amendment meets the applicable criteria in the Atomic Energy Act of 1954 as amended by the Nuclear Non-proliferation Act of 1978.
