IMPOSITION OF CIVIL PENALTY - $52,000 EN 81-47, dated December 23, 1981, notified the Comission of a proposed civil penalty to be issued to Indiana and Michigan Electric Company in the amount of

$80,000. The proposed action was based upon several violations relating to the licensee's failure to implement its fire protection program and maintain contain-ment integrity. The in-service testing program for various fire protection systems was not implemented, certain tests and inspections were not conducted on a timely basis, and the accuracy of information provided to the Comission regarding the fire protection program was not assured. Also, adequate control over surveillance testing procedures to assure that such testing did not affect the operability of systems important to safety was not maintained in that the performance of a leak rate test resulted in a breach of containment integrity.

The licensee responded to the Notice in a letter dated March 1,1982. After consideration of the licensee's response, the IE staff concluded that one of the proposed violations should be withdrawn and two violations were modified.

Accordingly, an Order Imposing Civil Monetary Penalty in the amount of $52,000 has been issued today. Under the terms of the Order the licensee may, within 30 days of the date of the Order, pay the civil penalty or request a hearing.

The licensee and the State of Michigan will be notified.
