AFFIDAVIT OF ROGER W. SINDERMAN I, Roger W. Sinderman, being duly sworn, do depose and state:

1.

I am employed by Consumers Power Company as Director of the Radiological Services Department. My business address is 1945 West Parnall Road, Jackson, Michigan. The Radiological Services Department has company-wide responsibility for Emergency Planning with respect to the nuclear power plants owned by Consumers Power Company, namely; the Big Rock Point Plant, the Palisades Plant and the Midland Plant. My organization has established Emergency Plans for each plant and provided technical support for any revision to the plans and their implementing procedures. The Radiological Services Department also participates in annual audits of the emergency plans and procedures.

Finally, I act as the Health Physics team leader for the company General Of fice Centrol Center which is estab-lished in the event of any emergency prior to the activation of the emer-gency off-site facility.

My organization is also responsible for coordinating the company emergency plans and procedures with the Nuclear Regulatory Commission, Federal Emergency Management Agency and other appropriate agencies of the f

to state and local county and township authorities in their development I

of state and local emergency plans. A detailed discussion of my educa-tional background and work experience is incorporated in the hearing re-cord as Consumers Power Company Exhibit No. 8 at Tr.1294.

The purpose of this affidavit is to explain the actions taken by Consumers Power Company with respect to the Atomic Safety and Licensing Board's Initial Lecision dated September 14, 1982. The actions taken to date are necessarily incomplete because more time is needed to assemble and document the necessary information in a manner consistent with the 1

Licensing Board's request for first-hand information.

complete response can be submitted to the Licensing Board by about i

December 3, 1982.

The Licensing Board suggested at page 8 of its September 14 l-Order that an appropriate expert should analyze several matters in con-t nection with the potential relocation of school children.

I have accepted this recommendation. Stone & Webster Engineering Corporation was retained on September 27, 1982 for this purpose.

I should point out, he.weve r, that l

l Stone & Webster has also been requested to gather f actual information with l

respect to transportation assistance for all people without vehicles within i

the 5 mile Emergency Planning Zone surrounding the Big Rock Point Plant, l

and to assist in the verification of the list of invalids maintained by l

the Sheriff of Charlevoix County. A report of Stone a Webster's investigation I

is expected to be submitted by the second week of November 1982.

There-s after, the report will be reviewed by my organization with appropriate response actions initiated by the end of November.

The Licensing Board stated in its September 14 Order that it had insufficient information concerning the radiological emergency response training program for state and local officials. The Emergency Services Division of the Michigan State Police is charged with this training respon-sibility under the State of Michigan Emergency Preparedness Plan. Accord-ingly, since the date of the Board's Order, we met with Emergency Services Division personnel on several occasions. Representatives of my staff met with Lieutenant James Tyler of the Emergency Services Division on Septem-ber 21, 1982, to discuss the Board 's Order. Subsequently, a telephone conf erence was held on September 24 among representatives of Consumers Power Company and its counsel, and Lieutenant Tyler and his immediate superior, Captain Peter Basolo. The purpose of this call was to discuss in more detail the ramifications of the Licensing Board's Order. A fur-ther meeting was held at the Michigan State Police Post in Traverse City, Michigan on September 28 to formulate a plan for responding to the Licens-ing Board 's Order. During this meeting it was agreed that Lieutenant Tyler would compile and document information regarding training.

Information on school children and other individuals needing transportation assistance would be ascertained from local officials by the Emergency Services Division Community Planning Specialist, Diane Ogren. On October 5,1982, members of my staff, Stone & Webster and the State Energency Services Division met to

l develop means for gathering the information identified as needed at the September 28 meeting.

It was agreed that Stone & Webster would assist the State Emergency Services Division in gathering information on the identity of invalids, the transportation needs of people without vehicles and other related matters.

In parallel with these meetings and discussions, Consumers Power Company, in cooperation with Detroit Edison Company and the Indiana

& Michigan Electric Company - the two other utilities in the State of Michigan which operate nuclear power plants - completed negotiations of an agreement with the State Emergency Services Division for financial assistance. The agreement, which was signed on September 30, 1982, pro-vides for long-term financial support to the State of Michigan for an assessment of the radiological consequences of potential nuclear accidents, protective actions required to prevent or mitigate such consequences, and necessary preparedness action including training for involved personnel.

This agreement was consummated as a result of negotiations on-going with the Michigan State Police since early 1982.

On October 11, 1982, a further meeting was held among repre-sentatives of Consumers Power Company and its counsel, Stone & Webster, and State Emergency Services Division personnel to discuss the preliminary results of (1) information assembled by Lieutenant Tyler and (ii) initial surveys conducted by Stone ' Webster in the Emergency Planning Zone of the Big Rock Point Plant.

I was informed at this meeting by Lieutenant Tyler

. i that substantial amounts of radiological emergency response training of I

state and local of ficials in the area of Big Rock Point Plant have been l

conducted over the last three years.

In accordance with the recent agree-ment referred to in paragraph 5 above, Lieutenant Tyler and his staff have l

begun to restructure the framework of the training program to facilitate trair.ing at all levels of government within the state.

During this meeting, I requested Lieutenant Tyler to prepare an affidavit for submission to the Licens ing Board. This affidavit will describe in detail the past and on-l going training efforts of the Michigan State Police regarding the radiolo-gical emergency response training effort in the area surrounding the Big Rock Point Plant.

In the meantime, supplemental training continues and a training session has been scheduled by Mr. Earl Muma, Emergency Services Director of Charlevoix County for Charlevoix School District bus drivers.

This training will occur on October 27, 1982, and it will include a dis-cussion of the response requirements for bus drivers in the event of an emergency at Big Rock Point as well as additional information on radiation exposure and ite ef fects.

Lieutenant Tyler's af fidavit should be completed by November 10.

It cannot be obtained sooner because of conflicting work assignments.

Lieutenant Tyler and his staff have on-going responsibilities with respect to the emergency planning activities for the Midland Plant and Detroit Edison 's Enrico Fermi Nuclear Plant.

In addition, Lt. Tyler and his staff have heavy 1

commitments of time and effort in connection with a NRC/ FEMA emergency exercise

. scheduled for October 21 at the D. C. Cook Plant owned by Indiana &

Michigan Electric Company. Finally, the work of the Emergency Services Division has been severely hampered by a fire in their offices which occurred on September 23, 1982. This fire was reported in the Lansing Journal (the article is attached as Exhibit A to my affidavit).

For all of these reasons, it is not possible to marshall the first-hand infor-mation and obtain the necessary affidavit within the 30-day deadline es-l tablished by the Licensing Board.

In its Order, the Licensing Board stated there was insufficient inf ormation with respect to the identity of invalids and their transporta-tion needs as well as others without vehicles.

Consistent with our approach on the matter of training, we intend to obtain affidavits from appropriate local officials regarding these matters. A meeting has been scheduled, under the auspices of the Emergency Services Division, for the early part of the week of October 18, 1982, to obtain this information.

that affidavits will be prepared by Mr. Earl Muma, the Charlevoix County Emergency Services Director, Mr. Vincent Olach, Business Manager of l

Charlevoix Public Schools and George Lasater, Sheriff of Charlevoix Coun ty. We were not able to meet with the local representatives before October 18 because of the need to establish first the organization of the present overall emergency planning program and its delineation of respon-sibility from the state level down through county and other local units of government.

This was accomplished during the meeting on October 11 described in paragraph 6 above.

Information obtained to date regarding the capacity of the Charlevoix County school buses indicates that sufficient seating is avail-able to relocate all Charlevoix School District children, the only school district within the Emergency Planning Zone.

(See the September 21, 1982, letter from V. R. 01ach to Mr. Earl Muma which is attached to my affidavit as Exhibit B.)

A similar letter from Sheriff Lasater to Mr. Muma, dated September 22,1982, (attached to my affidavit as Exhibit C. ) describes the procedure currently in use for maintaining an updated list of invalids and their means for evacuation.

In view of the training effort already in place and its on-going nature, coupled with the information in Exhibits B and C regarding identity of invalids and their transportation arrangements, as well as those of school children, substantial emergency planning efforts directly related to the concerns raised by the Board in its Order are in place in the area surrounding the Big Rock Point Plant.

Thus, I conclude that no emergency planning exigency exists with respect to these matters. There-fore, given the considerable progress made to date in attempting to address the Board's Order and the demonstrable need for more time, I conclude that a time extension to December 3 is both warranted and reasonable.

t In response to your inquiry regarding transportation availability for the students of the Charlevoix Public Schools in the event of an emergency, the following information is furnished.

The Charlevoix Public Schools have 20 school buses with a total rated pupil capacity of 1277 students.

Under ordin-ary loading procedures an additional 10% may be transported, thereby giving this school district a capacity of 14 04 students.

The total school enrollment (K-12) for School Year 82-83 is 1407 students.

The average daily absenteeism is a low of 3% with an average of 6%.

Using the low figure of 3%,

this represents 42 students, leaving a total of 1365 students to be transported, or 39 students less than our school bus capacity.

The route to be used in the event of an emergency will be ighway M-66.

All of our drivers are familiar with this 2ute and have driven it at one time or another.

Evacuation Plan for Charlevoix County pertaining to any man made or natural disaster," pertaining specifically to the special plan ~for Senior Citizens and Physically disabled of our County.

As your Sheriff I would like to explain.to.you what procedure to follow if we ever have to activate cny part of the. County for a disaster and you are involved in the evacuation:

1.

Prior'.to evacuation you will be alerted by phone, siren or radio and TV that an evacuation may odcur or is in effect.

2.

Special vehicles with an evacuation team will be dis-patched to your location for evacuation purposes. This team will.have at its disposal your name, address, age and physical disability if any. The team will also have all necessary equipment at its disposal in orfer to take proper care of your needs.

Prior to the arrival of your evacuation team I would like for vou to prepare some supplies that might be needed.

such as:

a. Medication.
b. Extra Clothing.
c. Toilet articles.

The evacuation team will transport you to Grandvue Care Facility in East Jordan where you will be cared for or released to whom ever you might request.

5.

Upon leaving your home, check the following areas before securing your door,

a. Family pets taken care of or brought with you.
b. In the winter months the heat set so your pipes will not freece.
c. Next of kin notified.

I have enclosed a sticker that I would lik'e for you to place on the front door of your home. This will alert the evacuation team of your residdnce.

In closing we hope that never have to activate the evacuation plan but, as your Sheriff, I feel that you, the public, should have ca much information as possible in an emergency situation.
