Dear Ms. Shoemaker:
Enclosed herewith are the NRC Staff's exceptions to the Atomic Safety and Licensing Board's " Order Denying Reconsideration" (September 30,1982).
The Staff's exceptions are filed pursuant to 10 C.F.R. 5 2.762(a), inasmuch as the Licensing Board's order constitutes a final decision and/er falls within the " collateral order" doctrine.
In view of the seriousness of the matters raised by this appeal, the Staff will attempt to file its brief in support of the exceptions on an expedited basis.
On Tuesday, October 12, 1982, the Staff will timely file a motion seeking to stay the effectiveness of the Licensing Board's order pending the issuance of a decision on the instant appeal.
