Dear Administrative Judges:
This letter is to memorialize a telephone call between Staff counsel and the ASLB Chairman on Friday, October 8,1982 to discuss the Staff's position on Applicant's Motion to Establish Hearing Dates _, dated October 1, 1982.
The Staff does not per g oppose Applicant's suggestion to hold the remaining evidentiary heorings in two phases, as this might well have the effect of expediting the conclusion of those hearings.
However, the dates suggested by Applicant in its motion pose an unalterable conflict with another heering (Point Beach) involving the Board Chairman and one of Staff counsel.
The Staff supports holding evidientiary hearings on all issues on which testimony has already been filed at the earliest possible opportunity. The remaining issues should be litigated as early as possible after the Staff has had an opportunity to review Applicant's pending submittals. The Staff's position recognizes, but is not altered by, the argument that a split hearing process might cause Intervenor's counsel to incur additional travel costs.
