PROPOSED ABNORMAL OCCURRENCE - PRESSURE TRANSIENTS DURING SHUTDOWN AT A NUCLEAR POWER PLANT We have reviewed your June 3 memorandum on the subject proposed A0 and the draft Commission Paper and Federal Register letter appended thereto.

Based solely on the information contained therein, we cannot concur with your assessment that this is an Abnormal Occurrence. We base this finding on the fact that analysis shows the integrity of the pressure vessel was not impaired and the fatigue life was not affected.

If you choose to list this incident as an A0, we recommend that you expand the discussion of the potential con-sequences of the transients, as they relate to vessel integrity.

As presently written, the information on the Westinghouse analysis appears to conflict with the statement that the pressure transients had the potential for brittle fracture of the reactor vessel if significant flaws were present and the transients had not been promptly terminated by operator action.

The dis-cussion should include a description of the size of the flaw necessary for propagation and an indication of the likelihood of such a flaw existing undetected.

Furthermore, since fixes have been implemented to supposedly eliminate these types of transients, we suggest that a review be conducted to determine the correct frequency of such events in order to evaluate the effectiveness of the fixes.

This type of supporting information should be provided before this event is categorized as an abnormal occurrence.

I therefore request that, if you determine that some portions of the requested information are exempt, you provide me immediately with a copy of the remainder of the information.

I, of course, reserve my right to appeal any such

- decisions.

If you determine that some or all of the information is exempt from release, I would appreciate your advising me as to which exemption you believe covers the material which you are not releasing.

I am prepared to pay reasonable costs for locating the requested material and reproducing it.

The amended act permits you to reduce or waive the fees if it "is in the public interest because furnishing the information can be considered as primarily benefiting the public."
