This motion is made cut of an abundance of caution in view cf the drastic consecuences that wculd folicw if the suspension orfer of September 28, 1978, issued by the Licensing 3 card in the abcve prececding should be allowed to take i. media:e effect. Our understanding of Section 2.760 of the Commission's Rules, when read in juxtipesition with Section 2.764, is that such a resul: will nct occur in a Shcw Cause proceeding of the

However, if we have misunderstood Sections 2.760 and 2.764, our motion to stay the effectiveness of the Initial Decision on Order To Show Cause is obviously required.

While Section 2.788 (f) of the Commission's Rules also allows for the filing of such a motien with the Licensing Board whose order is subject to the stay request, it seems to us more appropriate in this particular instance to proceed in this forum in light of the. fact that the stay relief being sought is for the purpose of preserving the jurisdiction of the A'ppeal Board to hear and determine the important and novel issues raised by Union Electric Company in its filed exceptions. It is for this reason that we have elected to bring the matter di-rectly to the Appeal Board.
