Dear Ms. McMurray:

As you know, the Nuclear Regulatory Commission reluctantly withdrew from participation in a recent meeting at the International Atomic Energy Agency (IAEA) to revise the regulations for radioactive material transport packages.

We could not agree with the U.S. positions to be advocated at the meeting.

Both the Department of Transportation (DOT) and the NRC have statutory responsibility for assuring safety in the transport of radioactive materials.

On June 8, 1979, the two agencies signed a Memorandum of Understanding (M00) to coordinate their regulatory activities in this area.

Under the MOU, DOT is responsible for regulation of carriers, vehicle safety, driver training and routing. NRC is responsible for regulation of packages containing fissile materials and larger quantities of other radioactive materials.

We believe the roles of our agencies need to be adjusted with respect to the development of IAEA transportation rules.

In our view, the responsibilities for development of IAEA transportation rules should be consistent with the domestic responsibilities of each agency; i.e., DDT should be the representative for matters concerning carriage and NRC should be the representative for matters concerning package safety standards.

We look forward to DOT and NRC continuing their close cooperation in assuring the safe transport of radioactive materials.
