Dear Administrative Judges:
The parties to the proceeding wish to confirm the schedule j
for the second phase of the evidentiary hearing.
According to the Board's Order of May 7, 1992, Memorandum and Order (Memorializing Prehearing Conference), ASLBP No. 91-641-02-ML, the schedule for the i
second phase of the hearing is dictated by the date of issuance of the Final Environmental Impact Statement ("FEIS") prepared by the NRC in connection with this licensing proceeding.
Whereas the FEIS was issued on August 29, 1994, the schedule for the second phase of the proceeding, according to the Board's Order of May 7, 1992, is as follows:
Discovery on Contentions B, I,
J, K,
Q, and W will end October 24, 1994 (8 weeks following issuance of FEIS);

Q, and W is due December 5, 1994 (6 weeks following end of discovery); and The evidentiary hearing on Contentions B, I,
J, K,
Q, and W will begin December 26, 1994 (3 weeks following filing of prefiled testimony).I' The Applicant and the NRC Staff are prepared to proceed on this schedule.
Because the hearing date falls during the holiday season, however, the Applicant and NRC Staff would be amenable to a brief delay in commencement of the hearing.
Applicant and NRC Staff envision a delay of no more than two weeks, such that the second phase of the hearing would begin no later than Monday, January 9, 1995.
(The deadlines for completion of discovery and filing of prefiled testimony could also be extended for two weeks.)
Intervenor advises that it is awaiting responses from potential witnesses regarding availabi'.ity and will propose an alternative schedule to the Board by October 15.
We ask that the Licensing Board issue an Order confirming the schedule for the remainder of the proceeding.
The parties are prepared to participate in a prehearing telephone conference, as necessary, to reach agreement on the schedule.
