Gentlemen:
i The Licensing Board has recently ruled that Mr. Kohn may depose Mr. Ebneter and Mr. Brockman and that the Georgia Power Company may depose Messrs. Ebneter, Brockmar., Chaffee, Peter Taylor and Larry Robinson.
The Staff will respond to discovery on October 14, 1994 as stated in our September 16, 1994 NRC Staff Motion for Extension of Time.
Since we expect that these depositions will complete both GPC's and Intervenor's deposition discovery of these individuals, it n..' es good sense to wait until you both j
have the NRC discovery responses prior to deposing NRC employees.
The following is a tentative schedule of availability of the above-listed NRC employees, which may change subject to the demand of their NRC work:
Mr. Taylor - October 19 (Wednesday) in Atlanta; Mr. Ebneter - October 20 (Thursday) afternoon starting no earlier than 1 p.m. in Atlanta; Mr. Chaffee - October 21 (Friday) at White Flint; Mr. Brockman - October 26 or 27 (Wednesday or Thursday) at White Flint; and Mr. Robinson was requested to be avail ele after the completion of all depositions.
Mr. Robinson can be available for deposition in Atlanta, November 2 or 3 (Wednesday or Thursday).
The Licensing Board's orders of September 19 and 29, 1994 and 10 C.F.R.
s 2.720 (h)(2)(1) provide sufficient guidelines to establish the permissible parameters for the scope of the depc;itions. We expect adherence to the limits established by the Licensing Board and the regulations.

-2 October 5, 1994 Mr. Lamberski inquired about the 88 inches of material in the Atlanta Regional Office which may be examined only after it has been reviewed.
Because of the large number of pages that must be reviewed, before release, it does not appear that this material will be available for review by the parties for some time.
