Wisconsin Radioactive Waste Review Board requests that the U.S.

Nuclear Regulatory Commission enter into negotiations regarding the construction and conditions of operation of the proposed WLsconsin Electric Power Company independent spent fuel storage facility at Point Beach Nuclear Power Plant Sir:

The Wisconsin Radioactive Waste Review Board has determined that the constmetion and opemtion of an independent spent fuel stomge installation at a nuclear power plant in Wisconsin is a matter related to the long-term disposal of high-level radioactive waste within the meaning of Section 36.50, Wis. Stats.

Wisconsin Electric Power Company has applied for a Cenificate of Authority from the Wisconsin Public Service Commission of Wisconsin under Section 196.49, Wis.

Stats., to constmet and operate such a facility at the Point Beach Nuclear Plant in Two Rivers, Wisconsin.

Therefore, the Board has determined that Section 36.50 (8) (b), Wis. Stats.,

specifically requires the Board to negotiate an agmement with the U.S. Nuclear i

Regulatory Commission, which is the principal agency of the federal government responsible for mgulatory oversight of the proposed WEPCO facility. Such agreement, once negotiated, must be put into effect by formal adoption into state law by t!ie Legislature and the Governor, in accordance with Section 36.50, Wis. Stats.

However, under Wisconsn law, the authority to approve an agreement regarding a matter : elated to the long-term disposal of high-level radioactive waste resides solely with the Legislature and the Governor. Under Section 36.50, Wis. Stats., and consistent with its statutory obligations on behalf of the citizens of the State of Wisconsin, the Wisconsin Radioactive Waste Review Board is therefore seeking to negotiate an agreement with the federal government that covers the constmetion and operation of the proposed WEPCO frility.

If an agreement is negotiated, the proposed agreement must be submitted to the legislature for its consideration, as required under Section 36.50 (10), Wis. Stats., and is subject to executive action with respect to the legislation sent to the Office of the Govemor.
