NOTICE OF ENFCsCEMENT DISCRETION FOR TENNESSEE VALLEY AUTHORITY REGARDING SEQUOYAH NUCLEAR PLANT (UNIT 1)

By letter dated June 21, 1993, you requested the U.S. Nuclear Regulatory Commission (NRC) to exercise its discretion to not enforce compliance with the required actions in Technical Specification (TS) 3.9.6.

You informed the NRC on June 21,1993, at 1:00 p.m. EST, that the Sequoyah Nuclear Plant would not be in compliance with the TS ACTION statement, in that a fuel assembly would be moved with the auxiliary hoist instead of the manipulator crane. You provided as justification for continued fuel handling operations that the auxiliary hoist was necessary to move fuel assembly H64 that tipped frem its designated core location during refueling.

The assembly was leaning approximately 20 degrees off vertical, and the recovery plan would not allow strict compliance with TS 3.9.6.

This TS allows only the manipulator crane to be used for movement of fuel assemblies.

In addition, you identified compensatory measures to include adherence to procedural requirements, visual observation of the load cell, and communication between refueling personnel and control room personnel.

i Based on our review of your justification, including any compensatory measures identified above, we have concluded that this course of action involved i

minimum or no safety impact, and we are clearly satisfied that this exercise of enforcement discretion was warranted from a public health and safety perspective. Therefore, it is our intention to exercise discretion not to
