SUBJECT:

NOTICE OF VIOLATION

(NRC INSPECTION REPORT NOS. 50-327/90-37 AND 50-328/90-37)

This refers to the inspection conducted by P. Harmon of this office on

November 6,1990 - December 5, 1990.

The inspection included a review of

activities authorized for your Sequoyah facility.

At the conclusior, of the

inspection, the findings were discussed with those members of your staff

identified in the enclosed inspection report.

Areas examined during the inspection are identified in the report.

Within

these areas, the inspection consisted of selective examinations of procedures

and representative records, interviews with perscnnel, and observation of

activities in progress.

Based on the results of this inspection, certain of your activities appeared to

be in violation of NRC requirements as specified in the enclosed Notice of

Violation.

We are concerned about the violations because they appear to be

directly related to issues that have been identified in previous inspections

concerning control room comand and control, and the site nuclear engineering

staff.

Although Violation A appears to be similar to Violation

50-327,328/90-29-01

in that they both involved inoperable nuclear

instrumentation, we have concluded that they occurred for different reasons

and that the corrective action for the previous violation would not have

prevented Violation A.

In addition to the need for corrective action regarding the specific matters

are concerned about the conduct of the

Specifically, the Nuclear Engineering

Section and the Operations Department shift crews.

Our concerns were

previously discussed in a meeting with TVA Management on November 27, 1990.

We understand you are intending to followup that meeting with a letter

documenting planned improvements in these areas.

You are required to respond to this letter and should follow the instructions

specified in the enclosed Notice when preparing your response.

response, you should document the specific actions taken and any additior il

actions you plan to prevent recurrence. After reviewing your response to this

Notice, including your proposed corrective actions and the results of future

inspections, the NRC will determine whether further NRC enforcement action is

necessary to ensure compliance with NRC regulatory requirements.
