Subject 1 IMPOSITION OF CIVIL PENALTY - $7,500 By EN 90-063 dated June 26, 1990 the Coninission was notified of the intent of OE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $7,500 to Mississippi X-Ray Service, Inc. This action was based on violations of requirements for industrial radiography on April 26, 1990 near Richmond, Virginia.
The licensee responded to the Notice in etters dated July 23, August 31, and September 17, 1990 and sought mitigation based on the small size of the business and the hardship that the propotid civil penalty would impose. After careful consideration of the licensee's rtsponse, the staff has concluded that the violations did occur as set forth in.he Notice of Violation and proposed linposition of Civil Penalty, and that based on the licensee's financial infortnation the civil penalty should be imposed in the amount of $7,500. The licensee is being given the alternative of paying the civil penalty in install-ments.
Accordingly, an Order Imposing Civil Monetary Penalty in the amount of $7,500 has been issued today.
Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
