September 2, 1983 MEMORANDUM AND ORDER (Memoralizing Conference Call of September 1)

The Atomic Safety and Licensing Board in the above-captioned proceeding held a Conference Call with the parties on Thursday, September 1, 1983 at 1:30pm. The following parties participated:

William Cormier (UCLA)

Daniel Hirsch (CBG)

John Bay (CBG) 0-l Colleen Woodhead (NRC Staff)

Although informed of the Conference Call, the City of Santa Monica did not participate.

The purpose of the call'was tiresolve several matters in dispute in preparation for the presentation of CBG's direct case during the week of October l'1.

The following issues were discussed:

CBG requested.an opportunity to present rebuttal testimony to UCLA's and Staff's direct case. The request stems from the somewhat 8309070168 830902 PDR ADOCK 05000 C

+1 2-unusual circumstances of this case, in which all parties filed testimony simultaneously.

The Board afforded CBG an opportunity to file an outline of its proposed rebuttal testimony by September 26.

A dispute exists among the parties with regard to UCLA's and Staff's perceived difficulties with cross-examination of CBG's witnesses, who are scheduled to testify in panels.

It was alleged that effective cross-examination would not be possible unless CBG furnished information on which witness was sponsoring each particular section of testinony.

To facilitate effective cross-examination, the Board asked CBG to furnish information on the composition of each panel and the principal contributions of each witness to the testimony. This information will be served by express mail on September 14.

If necessary, a conference call will be held on September 21 at 1:30pm, EDT to discuss any problems arising from CBG's filing.

Judge Bright requested that he be furnished with documents pertaining to all amendments other than Amendment 3; The parties agreed to consolidate their information and make it available to the Board.

The Board intends to rule on all pending objections concerning the scope of witness testimony before the start of the October hearing.
