Dear Chairperson Hoyt and Members of the Board:

By Order dated July 28, 1983, the Board on page 2 of that Order required counsel for the State of Maine to be present during the entire hearing, unless prior leave of absence is granted by the Board.

Given the existing caseload within our office, it will be impossible for the State of Maine to have either Paul Stern or myself, the two members of the Attorney General's Office who have made an appearance in this case, to be present during the entire hearing as currently scheduled.

Our inability to be at the entire hearing is based solely l on our workload and existing case schedule and not on any vacation time. We do intend to be present during a significant portion of the hearing.

We thus request, pursuant to the July 28 Board Order dealing with procedures for the August hearings , that the Board grant the State of Maine appropriate leave of absence for the days on which the State is unable to appear at the hearing. -
