Counsel to Consumers Power Company previously disclosed information on June 20 and July 8 concerning the possibility of overflights of the Big Rock Point Plant by military aircraft.

The enclosed letter from Major John V.

Lyczkowski of the Ohio Air National Guard provides additional information concerning flights of military aircraft during early June in the vicinity of Big Rock Point.

It does not appear from either Major Lyczkowski's letter or Mr. Rowley's June 23rd memorandum (attached to my letter of July 8) that any of the aircraft passed over the Big Rock Point containment building.

Moreover, it does not appear that the military aircraft involved from the Wisconsin Air National Guard (the 128th tactical fighter wing) exceeded any flight restrictions.

Possible Overflights of Big Rock Point Mr. Joseph Gallo To:

1.

This letter is in response to your questions concerning overflights of the Big Rock Plant by military aircraft as reported by Consumers Power Company personnel.

2.

On or about 9 Jun 83, I received a call from Mr. Campe of the U.S. NRC.

He stated he had a report of an overflight of the plant on 7 Jun 83, and asked if I would investigate.

Investigation of the scheduling log 'for the VR-1634 military training route (MTR) showed that a flight of three A-10 aircraft had requested to fly the route on that day.

They were to enter at point Delta (located near the town of Horton Bay, MI, approximately 7 miles southeast of the plant.)

at 1405 local time.

These aircraft are from the 128 Tactical Fighter Wing based at Truax Field, Madison, Wisconsin.

Discussions with the 128 TFW Supervisor of Flying revealed the following information: A flight of three A-10's did fly the MTR that day. The flight leader stated his flight arrived a few minutes early at the entry point for the MTR, and he orbited his flight north of the point at about 1,500-2,000 altitude above grounci level. The flight leader stated to the Supervisor of Flying that he did not think he had overflown the plant.

An internal memorandum of Consumers Power Company dated June 23, 1982,

-indicated that two flights are believed to have occurred on consecutive days during the week of June 6,1983.

Based on the scheduling log for i

VR-1634 and further conversations with the Supervisor of Flying for the 128 TFW, I determined that the first flight was the June 7 flight i

discussed above.

The second flight on June 8 consisted of four aircraft, also from the 128 TFW.

We believe that the four aircraft split into two flights of two aircraft each.

The second of the two flights delayed its entry into the low level route by orbiting and returning to the entry point.

During its orbit, the second flight.is believed to have passed near the pl ant.

The no-fly areas in the area of the Big Rock Point Plant and the Charlevoix Airport are associated with, the use of Wolverine Military Operations Area (the Wolverine M0A).

The M0A was not being used by these aircraft, and therefore the no-fly restrictions did not apply.

Thus, no violation of 2 fly r rictions occurred.
