fication of the Protocol Governing Communications (Enclosure 1) submitted by J.
Xeppler's letter of March 28, 1983. At the April 13 meeting TERA stated its inter-pretation that the protocol regarding the noticing of meetings to discuss substantive matters is intended to apply to the findings stage, not during solicitation of infor-mation. On May 27, 1983, TERA issued a !!onthly Status Report which also contained a notice of a meeting to be held June 3,1983. The June 3 meeting in Ann Arbor discussed Confimed Items submitted as Attachment 3 of the May 27, 1983 Status Report and provided infomation which will establish the disposition of these items (i.e., whether they progress to the Findings stage). The NRC staff considers such j
discussions of Confirmed Itens to constitute substantive matters. Hence, the pro-tocol procedures for the June 3,1983, neeting nay not have been strictly followed.
l The staff requests that such future meetings be conducted subject to the Protccol,

including paragraphs 3 and 4 therein. We request that written minutes for the

June 3,1983, neeting be prepared by TERA and that these be served on the May 24, 1983, modified service list.

Keppler's letter of March 28, 1983, was requested. For/ convenience, a copy of the Protocol is enclosed (Enclosure 1). This letper responds to the request for clarification.
Our reconsideration of an existipg IDCV program restraint associated with re-work from the Construction Completion Program was requested April 13, 1983 and is also discussed.
Protocol On April-13, 1983, TERA tated its interpretation that the protocol regarding i
the noticing of meeting to discuss substantive matters is intended to apply to the findings stage,/not during solicitation of information. Hence, the protocol procedures fpr the June 3,1983 meeting may not have been strictly followed other than py announcing the meeting in Section 6 of the May 27, 1983 Monthly Status Repo t.

Cook Program Restraints At the April 13, 1983 raeeting, the liRC indicated it is re-examining its prior position that the construction verification portion of TERA's program should not be conducted until any construction rework for the Construction Completion Program (defined by CPCo's letters of January 10, June 3 and Ju'ne 10, 1983) for applicable systems has been completed. Since adoption of this position, another third-party has been named to overview the Construction Cofapletion Program, and TERA has noted that certain disadvantages are associated'with a pause in execu-tion of its IDCV program. The staff has completed review of its previous position and finds that this program restraint is no' longer needed.
