TRIP REPORT FOR ATTENDANCE AT MEETING 0F THE URANIUM ADMINISTRATIVE GROUP OF THE STATE OF VIRGINIA Travel to:

Richmond, Virginia, May 5, 1983

Purpose:

To attend a meeting of the Virginia Uranium Administrative Group (UAG) to discuss Marline Uranium Corporation's Study Plan for site characterization and selection.

Background:

In response to telephone requests from Virginia State government representatives Dan Williams (Virginia State Health Department) and John Daniel (Counsel for Virginia Coal and Energy Group, and staff to the Uranium Administrative Group), to Robert E. Browning and Dan E. Martin, respectively, it was agreed to have D. Martin attend the subject meeting to explain the NRC licensing process and be available to answer questions. The basic purpose of the meeting was to hear Marlin' Uranium Corporation present its Study Plan and decide as to approval to proceed.

Discussion: The formal meeting minutes issued by the UAG are attaci,cd; they provide an accurate description of the substance of the meeting, which was primarily informational in nature.

In addition, a list of UAG members are also attached.

Bird, Jr.,

Chairman of the Coal and Energy Commission.

Senator Bird indicated to the members of the Group and others in attendance that

Delegate Paul Councill would serve as his designee to the Group and consequently as Chairman.

Mr. Councill made several opening remarks indicating among other things that he hoped this Group could fill several voids relative to the mining and milling of uranium m

Following his comments, Mr. Councill requested that the members of the Group introduce themsel'es to the audience v

and express their particular concerns or desires relative to the work of the Group.

The next order of business to come before the Group was to take action on a plan for the "Swanson Uraniun Project" which had been submitted to the Group on April 15, 1983 by

Marline Uranium Corporation and Union Carbide Corporation.

The Group had requested a verbal presentation of the written plan.

Mr. Norm Reynolds, Presidept,of Marline Uranium Corporation addressed the Group on the history and activities of Marline in Virginia.

Mr. Steve Potts, member of the Washington, D.C.

law firm of Shaw, Pittman, Potts, Trowbridge and a member of the Board of Directors of Marline Oil Corporation addressed the Group.

Mr. Potts' comments addressed the state and federal regulatory controls applicable to the uranium mining and milling process.

He noted that his efforts have identified 14 federal statutes and 7 federal agencies as well as 12 state statutes and 8 state agencies that have some primary role or associated role in licensing a mine and mill complex and relevance to associated environmental concerns.

Ha alco~ indicated that a copy of applienble laws in a consolidated format was available to members of the Group through his office.

Mr. Bob Beverl.y, Director of Environmental Control at Union Carbide addressed the Group briefly.

He stressed the adequacy of existing state and federal environmental controls in the uranium mining and milling process.

He made brief comments relative to the agreemen't, non-agreement state issue and related the distinct similarities between uranium mining and other hard rock mineral mining activity.

Mr. David Windsor of the consulting firm of Gibbs and

[I Hill was the next person to address the Group.

Gibbs-and Hill is a subsidiary of Dravo consultants whlon has -

contracted with Union Carbide Corporation to work on the "Swanson Project".

Mr. Windsor-briefly related to the Group the scope of their effort for Union Carbide and presented verbally the plan which had previously been submitted.

Ehe noted the necessity of certain of these efforts building upon others and pledged to adjust their efforts as deemed advisable by the desires and requests of the Group during l

the balance of the year.

Mr. Windsor noted that their efforts will be undertaken l

in four phases:

1.

Site selection study 2.

Pre-operational monitoring plan (baseline efforts) 3.

Preparation' of environmental report 4.

Operational mpnitoring plan.

In his closing commants, Mr. Windcor noted the plan ao 4

submittod.msets tha. guidalinas of the operativo crutute and he commented that the industry has a technological history of minimizing environmental hazards through a sophisticated system of checks and balances.

Mr. Buttleman, representing the Council on the Environment noted for the benefit of the Group that they should not rely too heavily on current federal standards because their genesis is for climatological conditions which vary from the Virginia situation.

He stressed the need to have Virginia standards.

Pollucion Control Board and a gubernatorial appointee to the Group noted that she felt a more detailed plan was in order and that in the Group's efforts it should achieve public and peer review of documents and in,for,mation generated by the Group or for Group action and review.

The Chairman noted that he felt that the Plan before the Group now was an outline of efforts to be undertaken.

He requested and received assurance that the plan could be altered or amended at the request of the Group.

In response to an inquiry by Jerry McCarthy,. the Group was told that the site selection process would be complete by August.

Subsequently, Mr. Reyno'lds noted that this time frame referred to the mill site, that the mine site is known at present and could be demonstrated to the Group on May 17; the next scheduled meeting.

The final person to address the Group was Mr. Dan 4

Martin, a licencing official with tha Nuclear Regulatory Commission.

Mr. Martin had been invited to addresa ths Group by the staff.

Mr. Martin spoke to the Group in regard to the NRC licensing mechanism, noting its mandatory adherence to Federal Register requirements and comment

periods required on the Environmental Impact Statement and associated assessments in the licensing procedure.

In response to an earlier question by Senator Anderson, Mr.

Martin indicated that with retpect to post-closure custody. of a tailings disposal site it was a matter of negotiation as between the state and federal government.

In the event that a stat'e chooses to take custody'; they would

li' do so under federal license.

Mr. Martin stressed to the Group that it was his opinion that NRC Standards would apply in Virginia without modification to the Pittsylvani~a s'ite.

In addition, he indicated additional NRC authority exists to supplement existing regulation.

Mr. Martin offered, in terms of advice to the Group, that the site selection criteria is of utmost importance and urged a cautiousapproach in dealing with that aspect of the Group's work.

Following Mr. Martins' presentation Mr. Swanson made a motion that the Group adopt the Marline-Union Carbide plan.

The motion was seconded by Mr. Meyer.

The motion emcompassed the Chairman's desire that the plan be subject to a'lteration and modification as the Group progresses in its deliberations.

Mr.

Councill noted that the plan in his estimation was an outline for a mechanism to get the study underway; that it reflected the environmental concerns expressed to the Uranium Subcommittee and the criteria outlined in the statute (Ch.

3, 1983 Acts of Assembly).

Mr. Co-cill appointed Mssrs. Wolfe, Buttleman and Swanson to develop a preliminary work plan for the Group to l
