Pursuant to 10 CFR S 2.754, enclosed is the first installment of Applicant's Proposed Findings of Fact and i

l Conclusions of_ Law on Remedial Soils Issues.

These findings summarize the record compiled in this proceeding on Seismology and Seismic Models.

We expect to file our remaining findings on remedial soils issues by the end of July or early August.

When all these findir n are completed we will provide the Board and the parties with a single bound volume.

We recognize, of course, that the Licensing Board has not yet ordered the parties to file proposed findings.

However, we expect the Board will do so. See Detroit Edison Company l

(Enrico Ferini Atomic Power Plant, Unit 2), ALAB-709, NRC (January 4, 1983).

Moreover, the record on remedial soils issues is essentially complete - certainly on seismology i

and seismic models.M Therefore we believe our submitting proposed findings early will be helpful to the Board and to the other parties in reducing the time needed to complete their own review of the record.

If Applicant has yet to respond to Ms. Stamiris' Motion to Reopen the Record.

In addition we owe the Board and the Staff an affidavit on the long-term suitability of ethafoam.

The NRC Staff also will communicate to the Board the results of its review of Dr. Thiruvengadam's affidavit on the seismic analysis of Service Water piping and Dr. Peck's affidavit on dewatering settlement of the DGB, and their comments on our ethafoam affidavit.

In addition the Staff.will inform the Board whether they disagree with Applicant's identification of the line struck while drilling between the Turbine Building and the DGB.
