Dear Ms. Davis:

The Board is in receipt of your " Motion for Extension of Time to File Previously Submitted Amicus Brief." We assume from your filing that you are concerned because that brief-was filed before Miami Valley Power Project's (MVPP) motion which-it supports and that you now seek to refile the same brief following the filing of MVPP's motion.

Following the filing of MVPP's motion, the board ordered that responses to your request to file a brief be submitted along with responses to MVPP's motion. That order is attached. Consequently, your request to file a brief will be considered when those responses are received.

It is not necessary to refile your request or brief.

For your future reference, I wish to call your attention to 10 CFR Part 2, Subpart G.

Part 2 constitutes the Rules of Practice of the Nuclear Regulatory Comission and Subpart G the Rules of General Applicability. Within Subpart G,12.708 sets forth the formal re-quirements for documents. Among other things, i 2.708 requires that each filing before the Board shall be double-spaced and signed by the person (or his or her representative) submitting it. The proper caption indicating the judges of this Board and this proceeding may be found in the enclosed order.
