On April 12, 1983, the Applicant submitted to the Board a letter identifying which portions of the Deposition Transcript of Albert B.
Savage that it believed should be admitted into evidence. With the following exception, the Staff agrees with the Applicant. Lines 19 through 24, page 101, of the deposition transcript relate to a paragraph that was striken from Mr. Savage's testimony as being outside the scope of the contention (Tr. 19076-77). Accordingly, that portion of the deposition is irrelevant to the contention and should not be admitted into evidence.
