NOTICE OF RECEIPT OF APPLICATION FOR FACILITY OPERATING LICENSE; NOTICE OF AVAILABILITY OF APPLICM:TS' ENVIRONMENTAL REPORT; NOTICE OF CONSIDERATION OF ISSUANCE OF FACILITY OPERATING LICENSE; AhD NOTICE OF OPPORTUNITY FOR HEARING Notice is hereby given that the Nuclear Regulatory Conmission (the Comis-sion) has received an application fron Duquesne Light Conrany, et al. for a facility operating license to possess, use, and operate the Beaver Valley Power Station, Unit No. 2, a pressurized water nuclear reactor (the facility) located in Beaver County, Pennsylvania, approxinately 5 miles east of East Liverpool, Ohio and 22 miles northwest of Pittsburgh, Pennsylvania. The application was filed by Duquesne Light Company on behalf of itself and Ohio Edison Company, The Cleveland Electric Illuminating Company, and The Toledo Edison Company. The reactor is designed to operate at a core power level of 2660 rnegawatts thermal, with an equivalent net electrical output of approximately 836 megawatts.

Pursuant to the National Environmental Policy Act of 1969-and the regula-tions of'the Cormission in 10 CFR Part 51, the applicants filed an environmental report as part of the application. The report, which discusses environnental considerations related to the proposed operation of the facility, is being made available at Pennsylvania State Clearinghouse, Governor's Budget Office, P. Af ter the environmental report has been analyzed by the Commission's staff, a draft environmental statenent will be prepared. Upon preparation of the draft

. environmental statenent, the Comission will, among other things, cause to be published in the FEDERAL REGISTER, a notice of availability of the draft state-ment, requesting coments from interested persons on the draft statement. The notice will also contain a statement to the effect that any coments of Federal agencies and State and local officials will be made available when received.

The draft environmental statement will focus only on natters which differ from

.those previously discussed in the final environmental statement prepared in connection with the issuance of the construction pernit.. Upon consideration of coments subnitted with respect to the draft environnental statenent, the Comission's staff will prepare a final environmental statement, the availability of which will be published in the FEDERAL REGISTER.

The Comission will consider the issuance of a-facility operating license

'l to the applicants which would authorize the applicants to possess, use and operate the Beaver Yalley Power Station, Unit 2 in accordance with the provisions of the license and the technical specifications appended thereto, upon:

, of the Atomic Energy Act of 1954, as anended (the Act), and the Comission's regulations in 10 CFR Chapter I.

Construction of the facility was authorized by Construction Permit No. CPPR-105, issued by the Comission on May 3,-1974.

The applicants have advised that construction will be completed by December 31, 1985.

With regard to Executive Order 11988. Floodplain Management, the Beaver Valley 2 facility will have structures and construction activities located en the floodplain. The subject of floodplain nanagenent will be discussed in the Comission's environmental statenent referenced below.

Prior to issuance of an operating license, the Comission will inspect the facility to detemine whether it has been constructed in accordance with the application, as amended, and the provisions of the construction permit.

In addition, the license will not be issued until the Commission has made the findings reflecting its review of the application under the Act, which will be set forth in the proposed license, and has concluded that the issuance of the license will not be inimical to the coreon defense and security or to the health and safety of the public. Upon issuance of the license, the applicants will be required to execute an indemnity agreenent as required by Section 170 of the Act and 10 CFR 140 of the Comission's regulations.

By July 1,1983, the applicants may file a request for a hearing with respect to 'ssuance of the facility operating license. By July 1,1983, any person whose interest nay be affected by this proceeding may file a petition for leave to intervene. Requests for a hearing and petitions for leave to intervene shall be filed in accordance with the Comission's " Rules of Practice for Donestic Licensing Proceedings" in 10 CFR Part 2.

, t for leave to intervene is filed by the above date, the Commission or an Atomic Safety and Licensing Board designated by the Commission or by the Chairman of the Atomic Safety and Licensing Board Panel, will rule on the request and/

or petition and the Secretary of the Coenission, or designated Atomic Safety and Licensing Board, will issue a notice of hearing or an appropriate order.

As required by 10 CFR Section 2.714, a petition for leave to intervene shall set forth with particularity the interest of the petitioner in the proceeding and how that interest may be affected by the results of the proceed-ing. The petition should specifically explain the reasons why intervention should be permitted with particular reference to-the following-factors:

(1) the nature of the petitioner's right under the Act to be made a party to the proceeding; (2) the nature and extent of the petitioner's property,' financial, or other interest in the proceeding; and (3,) the possible effect of any order which may be entered in the proceeding on the petitioner's interest. The petition should also identify the specific aspect (s) of the subject matter of

'the proceeding as to which petitioner wishes to intervene. Any person who has filed a petition for leave to intervene or.who has been admitted as a party nay amend his petition, but such an amended petition must satisfy the specificity requirements described above.

BEAVER VALLEY POWER STATION, UNIT 2 The United States Nuclear Regulatory Comission is giving public notice that it is considering issuance of an operating license to Duquesne Lloht Company, Ohio Edison Company, The Cleveland Electric Illuminating Company and The Toledo Edison Company for operation of the Beaver Valley Power Station, Unit 2 located in Beaver County, Pennsylvania, approximately five niles east of East Liverpool, Ohio, and 22 miles northwest of Pittsburgh, Pennsylvania.

The notice provides that within 30 days efter publication of the notice in the FEDERAL REGISTER on June 1, 1983, any member of the public whose interest may be affected by the proceeding nay file a reauest for a public hearing in the form of a petition for leave to intervene with respect to whether an operating license should be issued.

Petitions for leave to intervene must set forth the interest of the peti-tiener in the proceeding, how that interest may be affected by the results of the proceeding, and the specific aspect (s) of the subject matter of the proceeding as to which petitioner wishes to intervene. Such petitions must be filed in accordance with the above-referenced FEDERAL REGISTER Notice and must be filed with the Secretary of the Comission, U. S.
