CHAIRMAN PALLADINO:

We will now convene an 3

affirmation and discussion meeting and ask the Secretary 4

to walk us through the item on the agenda.

5 MR. CHILK:

Mr. Chairman, the Commission has 6

before it a, draft decision on a proposed rule in connection 7

with its rulemaking on storage and disposal of high level 8

waste.

9 The draft decision, which is being approved for 10 public comment, makes five findings by the Commission, and 11 I'd just like to briefly recount them before I have the vote.

12 First, it finds reasonable assurance that the 13 safe disposal of high level radioactive waste and spent fuel 14 in a mined geologic repository is technically feasible.

5 15 Secondly, it finds a reasonable assurance that 3

g 16 a mined geologic repository will be available by the year 8

17 2007 and 2009, and will be available 30 years beyond the h

18 expiration of any reactor operating licenses.

19 Third, it finds reasonable assurance that high m

level radioactive waste and spent fuel can be managed in a 21 safe manner until the capacity is available.

22 It finds reasonable assurance that spent fuel z3 can be stored safely and without any significant 24 environmental ef fect for these 30 years beyond the expiration 25 of reactor operating licenses, and finds reasonable

independent onsite or offsite fuel storage 1

assurance that 2

will be available if needed.

3 The Chairman and Commissioners Roberts and 4

Asselstine have approved the decision.

However, Commissioner 5

Assalstine would have preferred to delete dry storage from 6

one of the Commission findings.

7 Commissioner Gilinsky agrees in part and disagrees 8

in part.

9 Commissioner Ahearne abstains.

10 Mr. Chairman and Commissioners Gilinsky, Ahearne 11 and Asselstine have separate views which will be attached 12 to the draft decision.
