SHAw, PITTMAN, PoTTs & TROWBRIDGE A PARTNERSMlp OF PROFESSIONAL CORPORAteONS Atomic Safety and Licensing Appeal Board Page Two May 13, 1983 May 6, 1983, Wisconsin's Environmental Decad.e (" Decade") re-quested the Appeal Board to direct Licensee to provide the pro-prietary information to Decade and to establish a procedure for public comment on the proprietary information. Commission regulations do not permit Decade's inspection of the information, and Decade has no standing to make such requests of the Appeal Board.

Decade is not, and has never been, a party to this pro-ceeding. Its petition for leave to intervene and request for hearing was denied by the Licensing Board, Special Prehearing Conference Order (Dec. 10, 1982), and the denial was affirmed by this Appeal Board, ALAB-719 (March 22, 1983). Because Decade is not a party, it is precluded from access to the proprietary information by Commission regulations. 10 C.F.R. S 2.790 (b) (6) .

Decade's petition for discretionary Commission review of ALAB-719 under 10 C.F.R. S 2.786 (b) does not entitle Decade to inspect the proprietary information. The filing of such a petition does not make Decade a party. Moreover, the proprietary information has no bearing on the issues brought before the Commission, and the denial of access to such information causes no prejudice to Decade in the pursuit of its petition.

Accordingly, Licensee submits that Decade's requests must be denied.
