EXEMPTION I.
Wisconsin Electric Power Company (the licensee) is the holder of Facility Operating License Nos. DPR-24 and DPR-27 (the licenses) which authorize opera-tion of the Point Beach Nuclear Plant, Units 1 and 2, respectively (the facili-ties) at a steady state reactor power level not in excess of 1518 megawatts thermal (rated power).
The facilities consist of Westinghouse Electric Corporation designed pressurized water reactors (PWRs) located at the licensee's site in Manitowoc County, Wisconsin.
The license is subject to all rules, regulations and Orders of the Com-mission.
II.
On November 19, 1980, the Commission published a revised Section 10 CFR 50.48 and a new Appendix R to 10 CFR 50 regarding fire protection features of nuclear power plants (45 F.R. 76602).
The revised Section 50.48 and Appendix R became effective on February 17, 1981.
Section III of Appendix R contains fifteen subsections, lettered A through 0, each of which specifies requirements for a particular aspect of the fire protection features at a nuclear power plant.
One of these fifteen subsections, III.G, is the subject of this exemption request.
Section III.G details the requirements for fire protection of safe shutdown capability. Specifically,Section III.G.1 requires that fire protection features shall be provided for structures, systems and components important to safe
- shutdown. These features shall be capable of limiting fire damage such that one train of systems necessary to achieve and maintain hot shutdown conditions from either the control room or emergency control station (s) shall be free of fire damage and systems necessary to achieve and maintain cold shutdown from either the control room or emergency station (s) shall be capable of being repaired within 72 hours8.333333e-4 days <br />0.02 hours <br />1.190476e-4 weeks <br />2.7396e-5 months <br />.
Section III.G.2 provides requirements to ensure that the objectives of Section III.G.1 are met.
Section III.G.3 specifies the requirements for alternative or dedicated shutdown capability necessary to ensure that the objectives of Section III.G.1 are met given that the specific provisions of Section III.G.2 cannot be met.
III.
By letters dated June 30 and October 11, 1982, the licensee requested an exemption from Section III.G, " Fire Protection of Safe Shutdown Capability" of Appendix R to 10 CFR Part 50 to the extent that it requires the installation of a fixed suppression system in the control room.
The licensee's rationale for the exemption is as follows.
First, the in-situ fire loading for the control room is low, and the presence of transient combustibles is strictly controlled.
Second, the room is covered by a fire detection system. Third, t'he room is continuously manned and a hose station and portable extinguishers are immediately available to assure prompt manual suppression of a fire.
Finally, an alternate safe shutdown system is available which assures that the plant can be shut down safely even if the control room is made temporarily uninhabitable by a fire.
We have evaluated the licensee's rationale and find it acceptable.
The installation of a fixed fire suppression system in the control room would not significantly increase the level of fire protection.
On this basis, we can-clude that the exemption should be granted.

Accordingly, the Commission has determined that, pursuant to 10 CFR 50.12(a),
an exemption is authorized by law and will not endanger life or property or the common defense and security and is othertsise in the public interest and hereby grants an exemption from the requirements of Section III.G of Appendix R to the extent that it reauires a fixed suppression system in the Control Room.
The Commission has determined that the granting of this Exemption will not result in any significant environmental imoact and that pursuant to 10 CFR 51.5(d)(4) an environmental impact statement or negative declaration and environmental impact appraisal need not be prepared in connection with this action.
This Exemption is effective upon issuance.
