Dear Mr. Lewis:
Enclosed for your information you will find a copy of the comments submitted by the Nuclear Regulatory Commission (NRC) to the Department of Energy (DOE) on their proposed siting guidelines.
In response to the requirements of the Nuclear Waste Policy Act of 1982 (NWPA), the DOE issued proposed general guidelines on February 7, 1983, (10 CFR Part 960) for the recommendation of sites for repositories for disposal of high-level radioactive waste and spent nuclear fuel in geologic formations.
The NRC, under provisions of the NWPA, is required to concur on these guidelines before they are issued in final form.
Although not required under the NWPA, the NRC decided to provide staff comments to DOE in response to its Federal Register notice.
These staff comments do not constitute Commission concurrence.
The Commission will consider the DOE revised guidelines and NRC staff comments in reaching its decision on concurrence.
We are making these comments available to keep you informed of the Commission's activities in support of the high-level waste repository licensing program.
