SUBJECT: NRC INSPECTION REPORT 50-298/93-05 (NOTICE OF VIOLATION)
This refers to the inspection conducted by Messrs. A. Singh and H. F. Bundy of
this office on February 1-5, 1993. The inspection included a review of
activities authorized for your Cooper Nuclear Station facility. At the
conclusion of the inspection, the findings were discussed with those members
of your staff identified in the enclosed report. Also, a telephone conference
addressing the Thermo-lag issues was held on February 8,1993.
In addition to
yourself and members of your staff Messrs. P. Madden, NRR and J. E. Gagliardo
and the above inspectors from Region IV participated.
Areas examined during the inspection are identified in the report.
They

included a review of your fire protection program and followup on previous
)
inspection items. Within these areas, the inspection consisted of selective
!
examinations of procedures and reprcsentative records, interviews with
I
personnel, and observation of activities in progress.
!
!
Based on the results of this inspection, certain licensee activities appeared
to be in violation of NRC requirements, as specified in the enclosed Notice of
Violation (Notice). The failure to properly assign fire watch personnel to
inoperable fire Srriers is of concern because of the uncertainty regarding
the use of Thermt lag material in untested fire barrier configurations. We
understand that you subsequently assigned suitably trained fire watch
!
personnel to the areas in question.

You are required to respond to this letter and should follow the instructions
specified in the enclosed Notice when preparing your response.
In your
response, you should document the specific actions taken and any a.Mitional
'
actions you plan to prevent recurrence. After reviewing you. response to this
Notice, including your proposed corrective actions and the results of future
inspections, the NRC will determine whether further NRC enforcement action is
necessary to ensure compliance with NRC regulatory requirements.
In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of
this letter and its enclosures will be placed in the NRC Public Document Room.
