IW f 0\\ 4 NRC/ EPA MEETING - JUNE 23, 1989 0
CONTINU0US INTERACTION AT STAFF LEVEL IN PAST THREE Y, EARS HAS HAD SOME CLEAR SUCCESS BUT MANY DIFFERENCES REMAIN KEY CONTRIBUTORS TO THESE DIFFERENCES:
RISK MANAGEMENT APPROACH,.. EXAMPLE - RECENT LETTER ON CLEAN AIR ACT OVERLAPPING PROGRAM JURISDICTION E.G., MIXED WASTE INSTITUTIONAL ISSUES s
SHORTAGE OF RESOURCES COMPETING PRIORITIES FOR EPA MANAGEMENT ATTENTION 0
RADIATION PROTECTION IS NRC'S ONLY MISSION IF EPA CAN RECOGNIZE NRC'S REGULATIONS AS ADEQUATE SAVE RESOURCES FOR BOTH AGENCIES REDUCE STATE /PUBLIC CONFUSION 0
APPROACH FOR RESOLVING DIFFERENCES NEED FOR TOP LEVEL ATTENTION AT BOTH AGENCIES l
SUGGEST JOINT EPA /NRC TASK FORCE T0 IDENTIFY SCOPE AND CONTENT OF ISSUES TO IDENTIFY ALTERNATIVES FOR RESOLUTION NRC STAFF NOW CATALOGING ISSUES - SUGGEST EPA DO LIKEWISE-(BERNER0 NRC LEAD)
TASK FORCE EFFORT OVER 3-4 MONTHS FOLLOWED BY l

NOTES FOR CHAIRMAN ZECH'S USE IN DISCUSSING p
NRC/ EPA INTERFACES WITH ADMINISTRATOR RE!LLY OF EPA i.
l L
Background
o The two Federal Agencies charged with protecting public health and safety from the uses of radioactive materials have different approaches in many areas where there are interfaces.
i o
Recently NRC and EPA have had disagreements or difficulties in the following areas:
airemissionstandardsforradionuclides(C.A.A.)
mixed radioactive and hazardous waste guidance standards for exemption from regulatory control (BRC) standards for disposal of naturally occurring and accelerator produced (NARM) waste low-level waste disposal standards standards for uranium mill tailings disposal l
probabilistic approach to HLW standard Delays in development of residual' activity limits l
o The current situation:
wastes both agencies' resources undermines public confidence in our ability (to regulate can cause statutory deadlines to be missed i.e.,
the deadlines for developing new low-level waste disposal sites under the Low-level Waste Policy Amendment Act).
Issues t
o The current situation is caused by a variety of factors Differing interpretation of mandates under existing statues Differing priorities in resource allocation and management attention for radiation issues Differing regulatory approach to risk management l
