LLWM staff has scanned the regulations that NYDEC has promulgated mlated to

transportation and disposal of low-level radioactive waste in the context of John McGrath's mesio-to you dated January 23, 1990. Based on our brief review we offer the following observations:

.(1) NYDEC has chosen to deviate significantly from Parts D and M of the suggested Stute Regulations (SSR's).
In order to provide a meaningful response to Mr. McGrath's request for specific incremental regulatory q
requirements, we would appreciate any comparative analysis'done by Mr. McGrath per item II.a. of NRC Staff Guidelines.for responding to t
Technical Assistance requests from Agreement States Non-Agreement States, LLW Com> acts and Unaffiliated States (Attachment te namo, entitisd Guidance on Tecinical Assistance Requests from States and compacts dated l
. March 28,1988).
(2) -While reviewing the package we did note that NYDEC has adopted language 5
thatisdifferentfromNRClanguageandtheSSR's.inareeswhereNRCasks for promulgation of identical regulatory requirements by the States. We i
would suggest that NYDEC look criti ally at their own regulations in this context in order to (a) ider.tify all such reguirements based on a review of the NYDEC~ regulations against SSR compatibility requirements; and-(b) provide a rationale for deviation from the SSR versions of these regulations.
(3) Providing NYDEC with a list of incremental LLW regulatory requirements after (1) and (2) above have been addressed will be relatively straight forward. However, because NYDEC has chosen to promulgate numerous LLW regulatory requirements in 6 NYCRR Parts 381 and 382 that address a

i technical, administrative, and procedural issues beyond the scope of 10 CFR
.Part 61, it will be difficult to ascertain compatibility with NRC LLW
- regulatter even with the cooption of additional 10 CFR Part 61 j
