This is to inform the Consnission that e Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $3,750 will be issued on or about March 30, 1990 to Northeast Nuclear Energy Company. This action is based on the shipsent of a package of radioactively contalkinated equipuent that had external radiation levels on a small portion of the surface of the package in excess of regulatory limits. The escalation and mitigation factors in the Enforcement Policy were considered and the base amount of the civil penalty was increased by 50% due to the prior notice of such an event which was provided by an Information Notice in 1988, it should be noted thret the licensee has not been specifically informes of the enforr.ement action. The schedule of issuance and notification it,:
Malling of Notice March 30,1990 Telephone Notification of Licensee March 30, 1950 The State of Connecticut will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imPostd by Order.
