On' December 21, 1989, Baltimore Gas and Electric Co.
~(Applicant or BG&E) filed an application for a materials license which would authorize it to possess spent fuel and-F other radioactive materials associated with spent fuel storage in an independent spent fuel storage installation r
(ISFSI), located on the site of BG&E's Calvert Cliffs Nuclear Power Plant in Calvert County, Maryland.
In response to a Notice of opportunity for a Hearing, published on February 9, 1990 (55 Fed. Reg. 4742), the State of Maryland, acting by and through its Power Plant and Environmental Review Division of the Department of Natural Resources (hereinafter, Maryland) on March 8, 1990 filed a timely Petition for Leave to Intervene.

~. This Atomic Safety and Licensing Board was established on March 29, 1990 to consider Maryland'c petition and to preside over the proceeding in the event that a hearing is ordered.
In response to Maryland's petition, BG&E filed a response on March 23, 1990, indicating that it has no r
objection to Maryland's showing of its interest in the proceeding, how that interest may be affected, and the specific aspects of the proceeding in which Maryland wishes to participate.
BG&E noted, however, that it will exploro with Maryland the possibility of resolving Maryland's
. concerns without the necessity for a hearing.
On March 28, 1990, the NRC Staff filed a response which likewise offered no! objection to Maryland's standing to participate but also joined the Applicant in indicating that it would explore settlement of the. State's concerns.
Pursuant to 10 C.F.R. S 2.714, it appears that Maryland has established its standing to' intervene and that, subject to submitting at least one acceptable contention in accordance with 10 C.F.R.
S 2.714(b), Maryland will be L
admitted as a party to this proceeding.
The Board is, of 1
course, mindful of the Commission policy encouraging settlements, where possible (10 C.F.R.
S 2.759), and also the policy of permitting the use of informal procedures to dispose ~of issues (10 C.F.R. S 2.756).
The schedule being adopted will be subject to possible modification to j~

0 s i accommodate such alternative measures of. dispute resolution.
The following schedule is hereby established:
1.
Monday, April 30, 1990 Filing of content' ions by Maryland 2.
Wednesday, May 16, 1990 Filing of responses by BGkE and NRC Staff.
3.
Wednesday, May 23, _1990 Prehearing Conference authorized by 10 C.F.R. S 2.752 The exact time and location of the conference will be identified in a later Board order.
In conjunction with the prehearing conference, the Board requests BG&E to arrange a site tour of the area of the site on which the ISFSI'will be located.
The tour should take place following the conference and be available for.the Board'and any parties or petitioners who wish to
. attend.
,1 In addition, the Board requests BG&E to forward to each Board member, by April 30, 1990,-copies of its application dated December 21, 1989, as amended, and to place-the Board members on the service. list for future amendments, pending l-the completion of this proceeding.
