This letter transmits the findings of the routine safety inspection conducted

by Mr. P. Kaufman of this office on February 20-22, 1990 at the Armed Forces

Rad'obiology Research Institute, Betheeda, Maryland.

The inspection consisted

of document reviews, interviews, and observation of activities. The results

were discussed with you and others of your staff at the conclusion of the

inspection.

Areas examined during this inspection are described in the NRC Region I

Inspection Report which is enclosed with this letter,

Within these areas, the

inspection consisted of selective examinations of procedures and representative

,

records, interviews with personnel and observations by the inspector.

,

The inspection included a review of the current status of the operator requali-

i

fication program, and the effectiveness of your corrective actions taken

'

subsequent to the issuance by the NRC of a $2500 Civil Penalty on March 22, 1989.

The penalty had been issued for a number of violations of NRC requirements

t

identified during an NRC inspection in October-November,1988,

t

During this-inspection the NRC determined that the operator requalification

training program was being satisfactorily implemented, and effective action

,

has been taken to correct the deficiencies identified in 1988. No violaticns

were identified during this inspection.

This letter also transmits the synopsis of an investigation conducted by the

NRC Office of Investigations (01) subsequent to the October-November 1988

i

inspection relative to inaccuracies identified in documentation associated with

licensed operator requalification trainir.g. Based on the 01 investigation, the

-

NRC found that required requalification training lectures had not been completed

prior to t b NRC inspection. Additionally, due to careless disregard for NRC

'

regulatic s, false information was submitted to the NRC on License Renewal

Applications (NRC Form 398s); in that requalification training was certified as

complete on the NRC Form 398 by the Training Co-ordinator and the Reactor

-

Facility Director.

However, as noted in the synopsis, there was insufficient evidence to conclude

that these individuals knowingly certified License Renewal Applications that

contained false information.

T

The NRC has evaluated the 01 findings and has determined that no further

enforcement action is warranted because (1) the civil penalty was issued, in

'

part for related issues in March 1989 (2) appropriate corrective actions have

been taken since that time, and (3) this inspection in 1990 confirms that the

corrective actions appear to have been effective to date in precluding recur-

rence of the violations. Nonetheless, any similar findings in the future may

result in more significant enforcement action,
