Dear Mr. Matthews:

This is in response to your.-letter of February 9,1990 in which you requested the NRC's review and concurrence on Revision D to the Uranium Mill Tailin Renedial Action.(UMTRCA) Project's Remedial Action Inspection Plan (RAIP)gs for the Green River, Utah site. The NRC staff has reviewed Revision D of-the RAIP, the Renedial Action Plan '(RAP).- and the response to NRC's conwents on Revision C.. The RAIP and-RAP reviews'were conducted concurrently and information from the RAP was used to complete the RAIP review. As a result of our review, the NRC staff: concurs with the RAIP Revision D.

It should also be pointed out that the Green River project construction was initiated'without a fully concurred RAP and RAIP. This resulted in the

. project being completed using a RAIP that had not.been concurred in by the NRC.

DOE-had to provide subsequent justification to adequately support their.

assertion that the provisions'in the RAIP, although different from the NRC

. guidance. were adequate to acconiplish the purpose of the RAIP and to ensure

.that public health and safety will be adequately protected. This situation

,should be avoided.in future projects.
