LOUISIANA ENERGY SERVICES SITE VISIT AND MEETING WITH STATE OF LOUISIANA DEPARTMENT OF ENVIRONMENTAL QUALITY-p On fionday, February 5,1990, ficssrs. Haunhney and Loysen visited the Homer, i

Louisiana, site of the proposed Louisiana Energy Services (LES) uranium

' enrichment plant. The purpose of this visit was to make a preliminary observation of the site and its environs.

The rural, 450-acre' site is about five miles northeast of the town of Homer, which is the seat of Claiborne Parish. The site is bisected by Parish road #39. The land rolls very gently, has heavy stands of pine trees, and is indistinguishable from the surrounding area. Off of rnad #39, there are a few unnamed roads where a few rural homes are situated. 'Just south of the site, there are a few more. homes, a church, and a cemetary.

Further south is Lake Claiborne, an eight mile-long lake around which many homes are situated. A State park is, located at the E

southeast end of the lake.

Driving toward the northern boundary of the site, L

we observed timbering activities.

It was not clear that the timbering was on L

the LES site; however, that is'possible, since the contract for sale of the property to LES includes timbering rir, hts by the former owner for one year.

Little activity of any other kind was apparent in the vicinity of the site, On Tuesday, Feb'ruary 6,1990, the NRC held a meeting was held with Michael t

L McDaniel, the Assistant Secretary of the State of Louisiana's Department of D,

Environmental Quality (DEQ), and 172 of his staff, including Hilliam Spell, s

i Administrator of the Nuclear Energy Division, who requested the meeting l'*

through Charles Hackney, the NPC Region IV State Liaison Officer. The purpose of this meeting;was to brief DEQ on the status of the LES project, to review l1 e

the properties and hazards of uranium hexafluoride, and to discuss mattars related to NRC and DEQ regulation of the LES project. A list of the meeting j

attendees is enclosed.-

The principal interest expressed by DE0 in the meeting was the regulatory jurisdiction and' responsibility of the NRC and Louisiana over the project.

.This interest; appeared to stem from Senator Johnston's separate legislation which would retain NRC licensing authority over uranium enrichment in H,

Agreement States' if licensing is performed under 10 CFR Part 40 (and Part 70),

. rather than Part 50'as presently required. We explained that NRC would have-

authority for regulation that it has for any other kind of facility.1 The same,

- principle.would ap)1y to licensing under Part 50.. Nevertheless, it was-not' o'

completely' clear w1ere the jurisdictional boundaries between NRC and DEQ regulation would be..in'all areas, including occupational health and safety, a

~ radiological and. chemical discharges.in air and liquid effluents, environmental monitoring, emergency preparedness, and transportation. We.

. agreed to review this issue v'th NRC legal counsel and to provide Mr. McDaniel j

i'4 e.with the.results of the review. We also' agreed to send Mr. McDaniel a package

~

'of publicly available, Project M-45 documents and to include him on the n

' distribution for such future documents.

Some of the DEQ representatives were concerned that LES had not yet contacted their offices to discuss potential requirements and to seek necessary permits and licenses. Others said that contacts had been made. We provided the telephone number of Howard Arnold, President of LES, to Mr. McDaniel so that the proper DEQ contacts could be coordinated with LES.

During she meeting, DEQ inquired about several other matters. These included whether LES (and NRC) will need to evaluate alternative sites to the one selected near Homer. We said that LES should discuss in its environmental report alternatives to the proposed action, which might include consideration of other sites; however, we did not believe that LES would need to consider l

I alternative-sites for_the proposed action, co long as the Homer site is clearly a satisfactory one.

NRC will have to reytew alternatives to the proposed action in an environmental assessment or environmental impact statement. DEQ also inquired about the applicability to the LES project of EFA guidance on' uranium enrichment.

None of the NRC representatives was aware of any such guidance, but we said that we would 'look into it. Mr. McDaniel i

asked if LES' charges to its customers would include costs for decommissioning of the DOE gaseous diffusion uranium enrichment plants, as included in DOE's present charges to its customers. This question apparently was based on a

. concern that customers might choose to purchase LES enrichment services to avoid having to pay for cleanup of the DOE plants. We said that LES would be subject to NRC's requirements on financial assurance for decommissioning, and that the costs associated with meeting these requirements would probably be passed on to LES' customers; however, we doubted that there is any requirement u

for LES to include in its charges costs for decommissioning of the DOE plants.
