Dear Senator Lieberman:

I am responding to Mr. Thomas C. Reynolds' letter of January 5,1990, in which he referred'Mr. Donald W. Del Core's letter of January 4,1990, to us for action.

Mr. Del Core's request for a status report on pending discrimination cases beforetheDepartmentofLabor(DOL)shouldbedirectedtotheDOL. While the NRC evaluates all DOL findings in cases 1.ike Mr. Del Core's, we do not normally.

take-action before the D0L issues its final agency decision. Depending,on the.

r circumstances of a case, the NRC may conduct its own investigation while the DOL review is continuing. Specifically, in response to'several issues raised by Mr. Del Core and Mr. O'Sullivan, we have initiated such an investigation by our Office of Investigations.

I am sending a copy of.this letter and of Mr. Del-Core's letter of January 4,1990, to the DOL's Office of Congressional Affairs.

During July 10-21, 1989 we performed an inspection of approximately 130 allegations concerning the operation of Millstone Nuclear Power Station, Unit No. 2, that.

were made by Mr. Del Core and others. We sent Mr. Del Core a copy of our letter to Northeast Utilities (the licensee) and. Inspection Report 50-336/89-13 dated October 11, 1989.

In our letter we had indicated that, in the future, we planned to direct allegations of the kind discussed in the inspection report to the licensee for resolution. We will monitor the licensee's allegation: processing program to ensure that it is responsive and thorough'.

Following the October 11, 1989 NRC Inspection Report on Mr. Del Core's earlier allegations, Mr. Del Core has been contacting our Region I headquarters staff and the Region I Resident Inspectors on a weekly basis regarding the status of his allegations and new concerns related to his earlier allegations. A number of NRC Inspection Reports (IR) related to Mr. Del Core's allegations have been issued since the July 10-21, 1989 inspection', IR.50-33.6/89-16, 89-22, 89-23 and 89-25, copies of which have been provided to Mr. Del Core. Our Region I staff discussed these reports with Mr. Del Core on January 16. and 19,.1990. We believe our reports, correspondence and verbal discussions with Mr. Del Core represent a significant response to his concerns.

Mr. Del Core is also requesting a copy of a letter to Chairman Carr from the Senate Subecenittee on Nuclear Regulation concerning his case. This correspondence is associated with an ong;ing investigation by our Office of Investigations.

Therefore, neither the NRC nor the Senate Subcommittee on Nuclear Regulation has released this inferiration.

of all allegations he has made from July 1989 throug September 5, 1989. These

allegations have been addressed in Inspection Report 0-336/89-23,~ dated January 19, 1990. Mr. Del Core has been given a copy f that inspection report.

Mr. Del Core is also requesting a copy of a-letter to C irman Carr from the.

Senate Subcommittee on Nuclear Regulation concerning his case. This correspondence is associated with an ongoing investigation by our Office of Investigations.

Therefore, neither the NRC nor the Senate Subcommittee on Nuclear Regulation has released this information.
