B.
Service of Documents / Notification of parties (1) Method of. Service and Computation of Time The original scheduling Order provided a unique system for service of documents, directing that when documents were to be served by a certain date, that meant they were to be received by the intended recipient by that date.
(Order of October 5,1989, p.2).
This has been costly to the intervenors, who cannot routinely afford Express services, and appears to contradict the Subpart L regulations regarding service 'and computation of time.
10 CFR 2.1203(d) and (e) state that computation of time is done in accordance with 10 CFR 2.710-2.711and service is to be done according.
to 10 - CFR 2.712.
These regulations indicate that service is complete when placed in the mail and that time for response is computed based on ti.e addition of 5 days when original service was by regular -mail and 2 days. If by express.
It in respo;ifully requested that the scheduling order be modified to follow this regulatory pattern regarding service.
