PROPOSED IMPOSITION OF CIVIL PENALTY - $50,000 This is to inform the Comission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $50,000 will be issued on or about March 14, 1990 to Commonwealth Edison Company. This action is based on a lack of management oversight for the licensed operator training program.
Specific violations involved:
(a)aseniorlicensedoperatorlimitedtofuel handling standing watch with an inactive license, and (b) the failure to upgrade

the Requalification Program when 10 CFR Part 55 was revised in 1987 to requiro lecture attendance (five control room operators missed seven of 11 scheduled lectures). Though Violation A was reported in an LER, the NRC identified Violation B.
Consequently, the civil penalty was neither mitigated nor escalated.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
Mailing of Notice March 14, 1990 Telephone Notification of Licensee March 14, 1990 The State of Illinois will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
