PROPOSED I!! POSITION OF CIVIL PENALTY - $100,000 This is to-inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $100,000 will be issued on or about March 12, 1990 to The Cleveland Electric Illuminating Company.
In July and November 1989, two control rods failed to properly insert into the core during scram time testing. This action b based on the licensee's failure to properly evaluate unsatisfactory scram time test results, failure to control nonconforming materials in the associated scram pilot valves, and failure to take appropriate corrective action for an identified scram time testing deficiency. The escalation and mitigation factors of the Enforcement Policy were considered and the penalty was escalated 100 per cent for prior notice and 50 percent for multiple examples. The penalty was mitigated 50 percent for identification and reporting.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
Mailing of Notice March 12, 1990 Telephone Notification of Licensee March 12, 1990 The State of Ohio will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Orcer.
