1 March 13, 1990 EN 90-002A 0FFICE OF-ENFORCEMENT NOTIFICATION OF SIGklFICANT ENFORCEMENT ACTION Licensee:

Iowa Electric Light and Power Company (EA89-214)

(DuaneArnold)

Docket No. 50-331

Subject:

WITHDRAWAL OF PROPOSED CIVIL PENALTY By EN 90-002 dated January 5,1990, the Commission was notified of the intent

~

of the Staff to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $25,000 to Iowa Electric Light and Power Company.

This action was based on an inadequate secondary containment test procedure that failed to detect a significant breach in the reactor building ventilation shaft.- The civil penalty. was mitigated 50% because_ of the unusual efforts of a system test engineer in identifying the problem.

No further mitigation was applied because the corrective actions, though adequate, were initially narrow.

The licensee responded to the Notice in a letter dated February 9,1990 requesting full mitigation based on their prompt and_ extensive corrective actions. After careful consideration of the licensee's response, the staff has concluded that the additional information concerning the re-evaluation of the design and test procedures for the other HVAC system, changes to the preventive maintenance program and the fact that the plant was not operating during this time period, merits an additional 50% mitigation. Accordingly, because the licensee identified the problem and undertook extensive corrective actions, the staff has concluded that full mitigation is appropriate and the civil penalty should be withdrawn.
