Dear Mr. Howard:
.We' have received your letter of January 31., 1990 regarding the ECOSAFE HIC-55 high integrity container topical: report (Wii-95).
Your letter is in responso to a letter we transmitted to you dated December 13, 1989.
In your letter you
-l discuss the circumstances concerning the decision that you are meking in regards to the proper licensing approach for the topical report (TR).
You recuested that the NRC suspend work activities on the TR for about 60 days in orcer for you to evaluate the situation carefully and make your decision on
-how the licensing effort on the TR should proceed.
We'are disappointed that you did not choose to respond to our December 13, 1989 letter with additional information requested in the_ April 1988 NRC y
transmittal.
We continue = to'believe that enough time has transpired for you
,and your licensor, AVANCER, to respond with additional information on the TR. We. understand, however, that decisions regarding the proper approach to take-in: licensing efforts must be_made' carefully and with full consideration of=all information Therefore, we agree to' suspend work on the ECOSAFE HIC-55

Otherwise,-

' Be advised that at the end of the 60 days during which we have agreed to take no action on your TR, we must receive a-transmittal from B&W concerning the' TR that-includes either (1) the-additional:
information requested in the NRC's' April 1988 transmittal,'(2)-a firm commitment;from B&W that we will receive the additional information-that providesadatewewillreceive-themthatispriortoJune1,1990,-or.(3)a 4
@ cision by B&W to wih; drew the TR.from further NRC' review.
If we do not receive such a transmittal on or before April 2,1990'(60 days from your January 31,:1990 letter to us), we will discontinue the ECOSAFE HIC-55 TR

You should be aware that~ if your decision is to withdraw the TR from further review, or if NRC discontinues the review, the docket will be closed.
This.
means that should you decide to re. submit the TR for review some time in the
' future, the NRC will charge you the necessary fees for. docketing, and the TR will be treated as a new submittal.
It will be given a new review priority ~
based on the work load at the tine of the submittal without regard to its carlier status, and it will require a new initial review resulting in a new first round of requests for additional information.
