APPENDIX A NOTICE OF VIOLATION Louisiana Power & Light Company Docket:.50-382 Waterford Steam Electric Station, Unit 3 Operating License: NPF-38
-During an NRC inspection conducted January 1-31, 1990, a violation of NRC
't.
requirements was identified. The violation involved failure of the licensee to ensure that operator license conditions were met for licensed operators on' duty as recuired by the Technical Specifications (TS).
L In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2. Appendix-_C (1989), the violation is listed below:
TS 6.2.2.b requires at least one licensed operator to be in the control room when fuel'is in the reactor.
In addition, while the reactor is in Mode 1, 2, 3. or 4, at least one licensed senior operator shall be in the control room.

10!CFR 55.53(1) requires operator licensees to have a biennial medical examination as a condition of their license.
Contrary to the above, on January 16 and 17,1990, a senior operator was on duty as shift supervisor while the reactor was in Mode 1, without having met the above medical examination-license condition since 9
September 23, 1989.- In addition, at least nine'other operators / senior L
operators stood watches for a number of days in the past 2 years without L
having_ met the biennial medical examination license condition.

Pursuant to the provisions of 10 CFR 2.201, Louisiana Power & Light Company is hereby required to submit _ a written statement or explanation to this office, within 30 days of the date of the letter transmitting this Notice. This reply should. include for each violation:
(1) the reason for the violation if admitted, (2) the corrective steps which have been taken and the results achieved.-(3) the corrective steps which will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
