EN 90-28 0FFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Tennessee Valley Authority (EA89-226)

(Browns Ferry)

Docket Nos. 50-259, 50-260, and 50-286

Subject:

NOTICE OF VIOLATION This is to inform the Comission that the staff intends to exercise broad discretion and not propose a civil penalty for a Severity Level III problem at Browns Ferry. Prior notice to the Comission is required before exercising this authority in accordance with Section V.G of the Enforcement Policy. The problem involved a number of violations encompassing many aspects of the licensee's curveillance testing program that includes:

inadequate test procedures, failure to meet test intervals, failure to implement and maintain compensatory measures and the failure to follow procedures. This action is being taken because suffi-cient managenent attenticn had not been directed to fully correcting identified problems and adequately implenenting surveillance progra": improvements developed since 1986, until the NRC became involved. The staff also notes that there have been numerous other minor violations involving the surveillance program during the Nst two years.

The exercise of broad discretion is deemed appropriate because all Browns Ferry Units have been in an extended shutdown since 1985, and the licensee is currently in the process of im)1ementing an NRC approved program to ensure compliance prior to startup. Also, tie licensee's overall performance in this area has improved substantially since they were niade aware of their weak perform 6nce, as evidenced by the lack of additional LERs and violations in this area.

It should be noted that the licensee has not been specifically inforced of the enforcenent action. The schedule of issuance and notification is:
