Raba-Kistner' Consultants, Inc.
Docket: '15000042/90-02 El Paso,-Texas-License: General'-(10 CFR 150.20)
During an'NRC inspection conducted on January 22 and 30, 1990, a violation of NRC requirements was identified.
In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1989) (Enforcement Policy), the violation is listed below:
-10 CFR 150.20(b)(1) requires that, prior to engaging in activities in non-Agreement States under-the general license granted by

j Contrary to the above, in 1988 and 1989, the. licensee used moisture / density gauges containing byproduct material at White Sands Missile Range.and at Fort Bliss, both of which are federal facilities, without making the required notification.
This'is a Severity Level IV violation.

Pursuant to the provisions of 10 CFR 2.201, Raba-Kistner Consultants, Inc., is hereby required to submit to this office, within 30 days of the date of the 1etter transmitting this Notice,.a written statement or explanation in reply, including for-each violation:
(1) the reason for the violation if admitted, (2) the corrective steps which have been taken and the results achieved, (3) the' corrective steps which will be taken to avoid further violations, and
. (4) the date'when full compliance will be achieved. Where good cause is shown, '
consideration will be given to extending the response time.
