Dear Mr. Matthews:

LIn a letter dated December 15, 1989, you provided a copy of the Revised Final EVorification Report for the Lakeview processing site.

You requested that NRC-conce with DOE that theLsite has been cleaned up in accordance with 40 CFR 192.

In a: subsequent request, DOE asked that we provide concurrence by January 31, 1990.

Normally concurrence.is provided only after both the ground water and the

. surface have been cleaned up.

At the Lakeview processing site, ground-water C.

cleanup has not been completed at^this time; however, you are requesting our-F

-concurrenceofthes'urfacecleanufonly,-inordertoaccommodatearequestfrom the private land owner that he be allowed the right to surface use.

YourLrequest raises a generic question in that there are several other UMTRA-sites where tailings are being relocated from the processing sites.

The generic question concerns-whether NRC can concur in DOE's release of a processing site prior to completion of -the ground-water cleanup.

We are currently discussing the issue with our legal staff and thus cannot provide our concurrence by January 31, 1990, as you requested. At this time, we.

cannot' provide an alternate. schedule for providing our concurrence, as that is n

dependent on obtaining an opinion from our legal staff.

We will however keep you apprised of our discussions with our attorneys', during our weekly conference calls.
