Dear Senator Bentsen:
This letter is in response'to your lett.er to Mr. Carlton C. Kamerer' dated October 4, 1988, regarding the concerns of Cap Rock Electric Cooperative Inc.

~(Cap Rock)..The Nuclear = Reculatory Comission (NRC) is currently conducting an updated antitrust operating -license "significant change" review of Unit 1-of the Comanche Peak Steam Electric Station (Comanche Peak) in accordance with our regulations.
In the course of this review, the NRC is seeking public coments regarding the applicant's activities that may have changed since the last antitrust review by the Comission in 1980.
Cap Rock, pursuant to this process, informed the staff of various competitive concerns it has reoarding TO Electric Comnany's changed
. activities in a filing dated Auaust 9, 1988:
"Coments Of Cap Rock Electric Cooperative, Inc. Concerning Sionificant Changes in Licensee's Activity That Warrant An Antitrust ~ Review At The Operating License Stage." We have enclosed, for your infomation, a copy of that filinn and TU Electric's l
response dated October 21, 1988, h
1 Tne aralysis of any changes in TU Electric's activities since the last l
antitrust review is continuing. The analysis considers not only Cap Pock's comments, but coments from other interested parties, as well as inforr'ation submitted by TV Electric Company.
Once-this information bas been reviewed,:
the: Director of the Office'of Nuclear P* actor Regulation (Director) will make a Findina as to whether or not there have been "significant changes" in TV Electric's activities.
-If the. Director concludes that there have been significant chances, his Finding will be forwarded to the Attorney General for his advice as to whether or not an antitrust hearing should be held as a result of the changed activity identified in the Director's Finding.
If the Director concludes that there g
were no significant changes in the applicant's activities, the Finding is then
, ublished in the Federal Register and interested parties have thirty days in p
which to request a reevaluation of the Director's Finding.
