the' report _ prepared by the Quality: Technology Company (QTC) for the Employee's Legal Project (ELP) can be addressed by an inde-pendent investigation.

The NRC staff provided its initial

. assessment'of the QTC report to the Commission as part of.the Commission's Seabrook immediate effectiveness review briefing on January 18, 1990.

The staff is continuing to evaluate'the QTC report, other documents submitted by ELP, and the applicant's January 26, 1990 response to the QTC report to determine whether

-these = documents raise significant new safety issues and is expected to provide an additional report to.the-Commission on 8

these' matters in the near future.

After receipt-of the staff report, the Commission will determine the need for any further H

review, including an independent assessment.

As you know, the decision on whether the Seabrook Station should be granted a fulP power operating license is currently before the i

Commission.

I can assure you.that we will not act on this matter l

until any safety issues raised in the QTC report that prove to be

In February. of '1987 members of the Massachusetts Congressional Delegation-first expressed their interest in and asked the Nuclear j

. Regulatory Commission to order an independent investigation of safety issues related to'Seabrook Station as raised and presented by'the Employees Legal Project.

In response, then Chairman of the Commission, Lando W. Zech, Jr.,

lwithout specifically addressing the~ alleged concerns nor the apparent breakdown in quality. assurance in'the Scabrook plant's design - and-construction, concluded the said concerns were

L unsubstantiated.

~ Consequently, the Employees Legal Project contracted with the Quality Technology Company and its vice-president, W. Scott Schum, a respected professional and highly regarded-expert in the field, p

.as well as ' a-former NRC investigator, to review and further investigate those unanswered safety questions concerning =the-plant t

and.its operation.

Enclosed is the Quality Technology Company's report which-' details safety -concerns regarding the Seabrook nuclear power

plant, including new matters recently brought _to its attention by individuals -associated with the plant.

It is the result of an independent investigation of issues raised by Seabrook employees and of available documents regarding those concerns.

We are convinced the investigation demonstrates that there still remain unanswered substantive questions regarding Seabrook e

Station's safety.

Therefore, in_ order _to ensure the plant's safe operation and to both. help restore the public's confidence in the Nuclear Regulatory s

Commission's licensing process and its regulation of the plant, we the-undersigned do hereby request that the NRC withhold its decision on the licensing of Seabrook Station until a comprehensive O
