Gentlemen:

This letter refers to our review of your activities conducted in the state of

Oklahoma- under reciprocity with Byproduct License No. LO2627 issued by the

state of Texas. This also acknowledges receipt of NRC Form-241, which you

submitted to report proposed activities in non-Agreement States under authority

of the general. license provided in 10 CFR 150.20.

,

During this review, certain of your activities were found not to be conducted

in full compliance with NRC requirements in that you failed.to provide

notification to NRC of your' activities in Oklahoma performed under the genera"i

license. Consequently, you are required to respond to this natter in writing,

in accordance with the--provisions of Section 2.201 of the NRC's " Rules of

Practice," Part 2, Title 10, Code of Federal Regulations.

Your response should

be-based on the specifics contained in the Noti.e of Violation enclosed with

this letter.

Our letter to you dated November 24, 1989, confirmed your commitment to cease

radiographic operations using~ byproduct materials at locations under NRC

jurisdiction pending further review by our office. We hereby grant permission

for you .to resume such activities in accordance with your Form-241 submittal

dated November 27, 1989. .Your Agreement State license is recognized as valid

for the- uses identified in that submittal.

The response directed by this letter and the accompanying Notice is not subject

to the clearance procedures of the Office of Management and Budget as required

-by the Paperwork Reduction Act of 1980, PL 96-511.

During a review of your activities, a violation of NRC requirements was

identified.

In accordance with the " General Statement of Policy and Procedure

for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1989) (Enforcement

Policy), the violation is listed below:

10 CFR 150.20(b) requires, in part, that any person engaging in activities

.

in non-Agreement States under the general license provided in

Section 150.20 shall file copies of NRC Form-241, " Report of Proposed

Activities in Non-Agreement States," with the Nuclear Regulatory

'

Commission.

'

Contrary to this requirement, the licensee did not provide NRC with this

notification for radiographic work using byproduct material conducted

November 13-20,.1989, in the state of Oklahoma, a non-Agreement State.

This is a Severity Level IV violation.

Pursuant to the provisions of 10 CFR 2.201, Panhandle NDT and Inspection, Inc., -

is hereby required to submit to this office, within 30 days of the date of the

letter transmitting this Notice, a written statement or explanation in reply,

including for each violation:

(1) the reason for the violation if admitted,

,

(2) the corrective steps which have been taken and the results achieved,

(3) the corrective steps which will be taken to avoid further violations, and

(4) the date when full compliance will be achieved. Where good cause is shown,

,

'

consideration will be given to extending the response time.
