MEETING TO DISCUSS CURRENT ISSUES CONCERNING THE PUBLIC FEALTH SERVICE This office is developing a response to the Comission's inquiry concerning possible methods of monitoring wrongdoers in the nuclear industry. As part of

that effort, we are examining the Health Care Quality Improvement Act of j

1986 (PL 99-660).

It requires creation of a national data bank for adverse information cn certain health practitioners who have been disciplined or had l

other negative actions taken as a result of their performance.

The Medicare and Medicaid Patient and Program Protection Act of 1987 (PL 100-93) expands i

the Itst of those health practitioners who will be included in the data bank, i

Attached for your information are copies of the pertinent acts, proposed regulations for the earlier act, the technical amendments added in 1987, and i

an information flow diagram for the data bank.

In seeking information as to the establishnent and operation of the data bank, OE has talked to Margo Wilson, Ph.D., the PHS staff person handling this program. We also provided her with information on two significant enforcement i

matters that appear relevant to the purposes of the data bank.

They are Milford Hospital (Dr. Delgado) and VA Hines (Dr. Freeman).

Rosano of OE met with Dr. Wilson on March 28, 1988. The question arose as to i

the possible role of the NRC as an agency that would provide information to be l

included in the data bank and also our possible access to the data bank for t

evaluating license amendments regarding practitioners.

The language of the

statutes is not clear whether the NRC qualifies for either function, and if the NRC desires a role, technical amendments to the statute may be i

appropriate. The PHS has just promulgated proposed regulations that would implement the 1986 act, and will be developing regulations for the 1987 act.

An imediate issue is whether the PHS should attempt to write a regulation that would include the NRC or seek a technical amendment to the statute.

Dr. Wilson indicates that the PHS wishes to establish direct liaison with the NRC on these matters.

Specifically, PHS needs to know what role the NRC desires, and whether that role should be established by regulation or amendment to the statute, and whether an agreement or MOV between the agencies is appropriate.
