OTHER WEIDMULLER PRODUCTS l

During a recent inspection conducted at Ralph A. Hiller Corporation (RAH),

Pittsburgh, Pennsylvania, our inspectors reviewed your letter, dated December 30, 1985, to RAH in response to their purchase order for the supply of environmen-tally qualified terminal blocks meeting the requirements of IEEE 323. The purchase order also invoked complionce to Appendix B to 10 CFR 50. Your letter stoted that it is your company's position that terminal blocks supplied by your company are " Commercial Grade" items and, as such, are not subject to the reporting requirements of paragraphs 21.3 and 21.7 of 10 CFR Part 21, 10 CFR Part 21, Section 21.3(a)(4)(a-1) states that if a specification unique i

to the nuclear industry is imposed by a customer's purchase order, the item is not connercial grade.

IEEE 323 is a specification unique to the nuclear industry. As such, a purchase order invoking the requirements of IEEE 323 must also invoke 10 CFR Part 21. Additionally, a manufacturer supplying components and certifying that they meet the requirements of IEEE 323 must comply with the requirements of 10 CFR Part 21, regardless of whether the purchase order invoked Part 21.

Therefore, Weidmuller Terminations, Incorporated must comply with 10 CFR Part 21 whenever Weidmuller accepts a customer's purchase order that invokes a specification unique to the nuclear industry (e.g., IEEE 323,10 CFR 50 AppendixB,ANSIN45.2).

Failure to do so would be a violation of NRC regulations. A copy of the Certificate of Compliance issued to RAH that was reviewed during the inspection is enclosured.
